In dissenting from tbe opinion of tbe Court, wbicb I am constrained to do, upon tbe highest considerations of private right and public policy, I feel much diffidence in expressing my own opinions, as tbey are so totally different from those of tbe Court. However, tbey are tbe result of my deliberate judgment, and as such must find expression, as I can not even silently concur in a decision, wbicb, to me, seems so dangerous in its tendencies, and so. devoid of legal basis in its conclusions.
