Appellee sued appellant, in the district court of Hidalgo county, to recover the balance due on a rental contract. The cause of action was based upon an alleged rental contract claimed to have been entered into by and between appellee, Richards, and appellant, city of Mission, acting through its mayor, H. F. Bishop, od or about the 2d day of July, A. D. 1921., and to begin on the 18th day of July, A. D. 1921, and to continue in force up to and including July 17, A.
