*236Judgment, Supreme Court, New York County (Michael R. Ambrecht, J.), rendered June 25, 2003, convicting defendant, after a jury trial, of grand larceny in the third degree, and sentencing him, as a second felony offender, to a term of 3 to 6 years, unanimously affirmed.

The verdict was based on legally sufficient evidence. The evidence warranted the inference that defendant, with intent to wrongfully withhold such money, withdrew more than $11,000 from his Municipal Credit Union (MCU) account by means of ATM machines, at a time when he knew that he had no money in his account, and also knew…
