DUFFY, District Judge.

This is an action brought pursuant to 42 U.S.C. § 405(g) to obtain judicial review of the Commissioner of Social Security’s final decision denying Tony Seabolt’s (“Seabolt” or “Plaintiff’) claim for Disability Insurance Benefits (“DIB”). The record includes a Report and Recommendation (“R & R”) of a United States Magistrate Judge, made in accordance with 28 U.S.C. § 636(b)(1)(B) and Local Rule 73.02(B)(2)(a), recommending that the Commissioner’s final decision be reversed and the case remanded to the Commissioner for further administrative action.
