This is a petition for a writ of quo warranto, brought under G. L. Chapter 111, to try the title of the com plainant and the respondent to the office of alderman for ward three in the city of Barre. Both were candidates for that office at the city election held March 6, 1923, and both claim to have been elected. The returns of the election officials show that the complainant received three hundred and ten votes and that the respondent received three hundred and eleven votes. The latter was declared elected, duly qualified, and still holds the office.
