Appeal from a decree of tlie Circuit Court of Patrick county, pronounced December 22, 1899, in a suit in chancery, wherein the appellant was the complainant, and the appellees were the defendants.

Morton Marye, Auditor of Public Accounts of the Commonwealth of Virginia, suing for the benefit of the Commonwealth and the county of Patrick, filed a bill in the Circuit Court of said county to enforce the lien for certain taxes due and unpaid upon a large tract of land, owned at the time the suit was instituted by J. Singleton Diggs. The bill charges that the title of this land was formerly in one John B. Allen, who remained charged with all the taxes-upon it down to the year 1894.
