I. INTRODUCTION
This matter is before the Court pursuant to Fed. R. Civ. Pro. 65 following a trial on the merits of Plaintiffs’ Complaint for injunctive and declaratory relief. At issue is Michigan’s “partial birth abortion” statute, Public Act 273, codified at M.C.L. §§ 333.17016, 333.17516, 333.16221(l) and (m), and 333.16226.
