SUMMARY ORDER

Defendant-Appellant National Life Insurance Company, Inc. appeals from a judgment of the United States District Court for the Northern District of New York (Lawrence E. Kahn, Judge) granting summary judgment in favor of PlaintiffAppellee Carol B. Speziale and directing *254National Life to pay her the death benefit due under a life insurance policy issued to her deceased husband, Thomas Speziale. Speziale v. National Life Ins. Co., 328 F. Supp.2d 295 (N.D.N.Y.2004).

ON CONSIDERATION WHEREOF, IT IS HEREBY ORDERED, ADJUDGED AND DECREED that the judgment of the District Court is AFFIRMED.
