Reversing.

On October 1,1928, and for some time prior thereto, the appellee and defendant below, Emby Duncan, ¡owned a parcel of land in McCreary county, Ky., containing about two acres, and upon which there were two small residence buildings, one located on either end of the tract and in one of which defendant and his family resided, while the other one was occupied by plaintiff and appellant, Elmer Duncan, as a tenant of defendant.
