Appeal by the plaintiff, Augustus H: Grote, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Kings on the 25 th day of August, 1906, upon thé decision of the court, rendered after a trial at the Kings County Trial Term, a .jury having been waived, dismissing the complaint.

JENKS, J.:
The action is to recover interest on an award for the taking of lands for public park purposes by the city of Hew York under chapter 522 of the Laws of 1884. The awards were confirmed on Decern*769ber 12,1888, whereupon title was vested in the defendant. On March 2,1891, demand was made upon the comptroller for payment. The award had been made to the “ Estate of F. Grote.” In J une, 1897, the plaintiff began a proceeding in the Appellate Division to have it determined that he was entitled to the award.
