Plaintiff Jonathan Foley (“Foley”) brings four claims against Wells Fargo Bank, N.A. (“Wells Fargo” or “the bank”). Foley contends that Wells Fargo (1) failed to abide by the terms of a class action settlement agreement which required Wells Fargo to consider Foley for certain mortgage modification programs and (2) violated various Massachusetts state laws.
