The plaintiff sues upon two causes of action, the first based upon a written contract, and the second upon an oral one. This written contract, the subject of the first cause of action, results from a written proposal of the plaintiff to the defendant, dated April 5, 1929, which proposal he accepted by a letter dated April 15, 1929, and concerns the sale by the plaintiff to the defendant of 403 lineal feet of fence, described as “ Habitant White Cedar Fencing,” identified as design No. 1225, Lenox style, to be erected by plaintiff upon the premises of the defendant, for a price of $778.
