Defendant in error owns the Sterling ditch, the headgate of which is located a few miles southwest of the town of Sterling. This ditch takes its supply of water from the South Platte river. Plaintiffs in error are the owners of ditches located about thirty-five miles further up that stream, and take their supply of water from that source.
