This is an action for replevin of a black angus heifer. Tbe plaintiff’s petition alleged that tbe plaintiff was tbe owner of tbe heifer, that tbe defendant wrongfully detained possession thereof, that tbe value of tbe heifer was $40. Tbe prayer was for a writ of replevin, immediate possession of the heifer and costs. Defendant’s answer was a general denial, except that be admitted tbe value of tbe heifer and that be bad possession thereof. His prayer was for dismissal of tbe petition, for costs and for tbe return of tbe heifer or judgment for its value.
