The appellant, Zachariah B. Rodgers, was charged with possession of a deadly weapon, resisting arrest and assault. The assault charge was apparently nolle prossed. At the conclusion of the trial in the Criminal Court of Baltimore (Karwacki, J., presiding), a jury found the appellant not guilty of possessing a deadly weapon but guilty of resisting arrest. He received a three-year sentence.
The appellant contends in this appeal that the trial judge committed reversible error by refusing to grant his motion for judgment of acquittal and by improperly instructing the jury.
