Grand River Dam Authority v. Grand-Hydro
Supreme Court of Oklahoma
1DissentHurst, C.J.
I think the judgment which is sustained in this case is grossly excessive and that a re-mittitur should be ordered. The exces-siveness of the judgment arises by reason of the fact that the jury and trial court acted on the assumption that at the time the lands were appropriated on January 19, 1940, Grand-Hydro had the right to use the waters of Grand River for hydroelectric purposes and that dam site value was an element entering into the measure of recovery.
In order to fully understand this case, it is necessary to consider the facts and history of the case and the pertinent legislation.
