Quillian, Justice.
The overruling of the demurrers to the petition as amended adjudicated that the petition set out a cause of action for some of the relief sought. That judgment, not having been excepted to, became the law of this case. It is therefore unnecessary for us to pass upon many of the legal questions presented and discussed in the briefs of the parties in this court, since those questions have already been decided, for the purpose of this case, adversely to the contentions of the defendants in error.
