The defendant was regularly indicted for murder, was tried by a jury, convicted of manslaughter in the first degree, and from the judgment of the trial court pronounced upon the verdict appeals.
The homicide ivas committed in a negro churchyard near the Alabama Great Southern Railway, about three miles west of Eutaw, in Greene county. The day of the homicide had been set aside by the church authorities for the observance of the ceremonial known as “foot-wasliing,” and the ceremonies attendant upon this religious rite appear to have attracted to the church, on this occasion,…
