delivered, the opinion of the court.

Tommie Lee was indicted,- tried, and convicted for unlawful cohabitation in violation of an, ordinance of the city of Oxford, and was convicted in the city court and appealed to the circuit court of Lafayette county, and was again tried and convicted, from which judgment he appeals.

It appears from the evidence that the city marshal and a constable, about the 8th day of September, 1923, made a search through the municipality for violations of the law, and went to the house of one Beulah Lucas without a search warrant and knocked upon the door,…
