Kidder Peabody & Co., Inc. (“Kidder”) appeals from a judgment of the Circuit Court of Jackson County enforcing an arbitration award entered by a three-member panel of the National Association of Securities Dealers (“NASD”) awarding $250,000 to Robert Madden. Prior to 1987, Madden had been a securities broker for E.F. Hutton, a competitor of Kidder. In 1986, John Ellspermann, on behalf of Kidder, contacted Madden regarding an employment opportunity at Kidder.
