The defendant below, the plaintiff in error,, was convicted, in the Bergen Quarter Sessions, of an assault *421with intent to ravish one Annie Jackson, a single woman, on the Bay Ridge road, which runs from Rutherford to Lyndhurst, in the county of Bergen, and, upon such conviction, was sentenced to imprisonment at hard, labor for three -years.

The assault took place shortly after five o’clock in the afternoon of March 30th, 1899, at or near a place on this road •called “ Dead Man’s Corner.”
