HOWERTON, Judge.

This is an appeal from a summary judgment dismissing appellants’ complaint. The facts are undisputed, but appellants contend that they were entitled to judgment as a matter of law, rather than the judgment which was entered on behalf of the appel-lees.

On February 28, 1975, the Kentucky State Board of Education adopted a Resolution merging the Louisville Independent School District with the Jefferson County School District.
