MEMORANDUM OPINION AND ORDER
LYNN, District Judge.
Before the Court is Plaintiffs Motion to Quash Defendant’s Jury Demand by Defendant Dennis Powell (“Powell”), filed January 11, 2002.
Plaintiff, RDO Financial Services Co. (“RDO”), argues liability in this action is based upon a Continuing Guaranty (“Guaranty”), executed by RDO and Powell to guarantee the debt of MWM Recycling Incorporated (“MWM”) in a lease transaction between RDO, the lessor, and MWM, the lessee.
