This case was originally determined in an opinion filed March 15, 1938, 278 N. W. 342. Petition for rehearing was granted and the matter is now before us for consideration.

The property involved is what is known as the Flynn building, located at the southeast corner of Locust and Seventh streets in the city of Des Moines. It is a tract 66 feet east and west on Locust street, and running back 132 feet on Seventh street to the east-and-west alley. ,On this tract is constructed a six-story building, the lower floor of which is occupied by stores and the other floors are used as shops and offices.…
