The plaintiff and one Opdyke, both being attorneys at law, represented a certain plaintiff in the United States District Court, and obtained a judgment against the defendant in that action in the sum of $6,047.84. From that judgment the defendant perfected an appeal to the United States Circuit Court of Appeals, Frank Bourett v. Roy Herman, Adm’r, 53 F. (2d) 1079, and the defendant in this action furnished a supersedeas bond upon appeal, conditioned that, if the defendant “prosecute his appeal to effect and answer all damages and costs if he fail to make his plea good, then the above…
