In an action, inter alia, for a judgment declaring null and void a stipulation of settlement and quitclaim deed, the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Westchester County (Colabella, J.), entered March 27, 2002, as *514granted those branches of the motion of the defendant Citibank, N.A., which were to dismiss the first and third causes of action in the complaint insofar as asserted against it pursuant to, inter alia, CPLR 3211 (a) (5).
