KRUEGER, JUDGE.
The appellant was tried and convicted of murder, and his punishment assessed at confinement in the state penitentiary for a term of 25 years.
The testimony shows that on the afternoon of July 2, 1932, deceased went in his car to the home of the appellant and from there they went in the deceased’s car to a picnic where a ball game was in progress.
