In this case a petition was filed in tbe name of the State on the relation of Judge 0. W. Tyler, of Montgomery County, in the Chancery Court of Davidson County, against Theodore E. King, Comptroller of the State, asking for a writ of mandamus to compel the defendant to issue a warrant on the Treasurer to pay the relator the sum of three hundred and twelve dollars and fifty cents, which he alleged was due him as a part of his salary as a judicial officer of the State. The petition was demurred to by the Attorney-general for the Statej who appeared on behalf of the State.…
