This suit for damages for personal injuries results from a very serious automobile accident in which two persons were killed, two others — one of them the plaintiff in this suit — sustained serious injuries and a Ford automobile was practically demolished, and a large truck was damaged. The time was about 1 o'clock in the very early morning of January 1, 1943, and the scene was about a mile west of Paradis, La., on U.S. Highway No. 90, which runs from New Orleans through Houma, La., towards the west.
