The plaintiff in a negligence action has appealed from a final summary judgment entered by the Gadsden County Circuit Court granting the defendant’s motion for a summary judgment on the ground that the plaintiff was contributorily negligent as .a matter of law.
The basic question presented for our determination in this appeal is whether, in view of the evidence before the court at the hearing on the said motion, the plaintiff was guilty of contributory negligence as a matter of law and, if so, whether the defendant was entitled to a summary judgment…
