Anthony Pyzdrowski, who had entered into a written contract, executed by certain individuals claiming to represent St. Mary’s Roman Catholic Congregation of McKeesport, for the erection of a church building, brought this action in assumpsit in the County Court of Allegheny County, to recover a balance claimed to be due on completion of the contract and acceptance of the building by the congregation.
