OPINION

STEPHEN RASLAVICH, Bankruptcy Judge.

Introduction:

The instant matter comes before the Court upon an objection filed by debtor Robert J. Thomas (the “Debtor”) to a proof of claim filed by the Internal Revenue Service (the “IRS”). A hearing on the objection was held on April 29, 1998, after the conclusion of which the Court took the matter under advisement. After receiving memoranda of law from the parties, the matter was submitted for decision by the Court on May, 26, 1998.
