BRETT, Judge:
Plaintiff in error, hereinafter referred to as defendant, was tried before a jury in the district court of Tulsa County, for the crime of larceny of an automobile. The jury returned a verdict of guilty, and imposed a sentence of eight years in the state peniten tiary. Defendant’s motion for new trial was overruled, and he was granted bail pending his appeal to this Court.
The information alleges that on October 27, 1963 the defendant stole a 1963 two-door Starfire Oldsmobile from the used car lot of one John Felts, in Tulsa, Oklahoma.
