KLINGEMAN, Justice.

Appeal by Delta Electric Construction Company, Inc., hereinafter called “Delta,” from a declaratory judgment rendered in the District Court in which the Court determined and declared that a contract for the erection of certain improvements to the water works system of the City of San Antonio, hereinafter called “City,” between Delta and the Water Works Board of Trustees of San Antonio, herein called “Water Board,” dated May 14, 1968, was null and void.
