On June 4, 1929, by separate instruments, one a separation agreement and the other a declaration of trust incorporated in the separation agreement by reference, petitioner provided for the maintenance and support of his estranged wife, and for the maintenance, support, and custody of his children. He retained no reversionary interest in the trust corpus or income upon termination of the trust. Prior thereto his wife had instituted proceedings for absolute divorce.
