The plaintiff in error, hereinafter referred to as the defendant, was convicted in the district court of Osage county, on a charge of driving an automobile while under the influence of intoxicating liquor, and his punishment fixed at a fine of $1,000 and imprisonment in the penitentiary for a period of six months. Motion for new trial was filed and overruled, and exceptions saved, and defendant has appealed to this court.
