GARRETT, Chief Justice.

This was an action for specific performance of a contract to convey land as well as for the recovery of damages stipulated for its breach, brought by J. S. Dougherty against W. W. Hoskins and others. The contention of the plaintiff was that he was entitled both to recover of the defendants the amount of damages stipulated in the contract for their failure to comply with its terms within sixty days and to have specific performance thereof by the conveyance of the land.
