This is an appeal by the plaintiff from a judgment dismissing his complaint upon the merits in an action to foreclose a vendee’s lien upon real property, that is, an action to recover a payment of $500 made on a land contract where the plaintiff as purchaser refused to take title on the ground that defendants did not offer him a marketable title. It was tried before the court without a jury.
