The appellant as administrator of the estate of Jane N. Pierce, deceased, late of Weber County, Utah, brought this action to recover a certain deposit of money which it is alleged was made by the deceased in her lifetime in the Pingree National Bank of Ogden, and in which money it is alleged the respondents Geo. T. Pierce and Caroline P. Dinsdale claimed some right or interest. The respondent bank answered the complaint, admitting that certain moneys had been deposited in the bank by the deceased, but disclaiming all interest in or right to said money or any part of it except as a depositary.…
