Appeal by the. defendants, Frederick Buse and others, from a judgment of. the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of' New York on the 19th day of December, 1896, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 12th day of January, 1897, denying the defendants’ motion for a new trial made upon the minutes.

This action was brought to recover damages for personal injuries alleged to have been suffered by the plaintiff as the result of the defendants’ negligence. The defendants, as copartners, were engaged in business in the .city of New York and conducted the hotel, known as the Cooper Union Hotel On the 11th of August, 1893, the plaintiff was engaged by one of the defendants as a chambermaid and was assigned to a room where she should sleep.
