Where the evidence is conflicting, as it was in the case Tinder consideration, it is very important that the jury should be accurately instructed on the questions of law involved in the case. If they are not so instructed, there is no certainty that a correct result- will be reached. The court gave for the defendant a short instruction, No. 1, as asked.
