delivered the opinion of the court:

In this case the judgment of the Appellate Court for the First District reversing the decree of the circuit court of Cook county and remanding- the cause, with directions to dismiss the bill for want of equity, has been brought up for review by writ-of certiorari.

On May i, 1903, Luke Wheeler purchased from defendant in error, the Postlewait Company, its livery business for $9400. Of this sum $1500 was paid in cash and three notes were given for the balance,—one for $500, payable in thirty days, one for $2000, payable in ninety days,…
