A death sentence was imposed upon appellant at the trial from which is this appeal. He was tried upon an information at the bottom of which the name of the prosecuting attorney was printed, but the information was signed by Henry E. Spitzberg, as deputy prosecuting attorney. The sufficiency of the information is questioned for this reason, it being insisted that to be valid it should have been signed by the prosecuting attorney personally.
