This is an appeal on law from a judgment on the verdict entered by the Common Pleas Court of Shelby County, Ohio, in favor of the defendant.

The plaintiff-appellant brought an action for damages arising out of a collision between the plaintiff’s Ford and the defendant’s truck, which occurred on September 20, 1944, at 7:30 A. M., on a public highway in Shelby County, Ohio, which extends in an easterly and westerly direction.
