Hawes, Justice.

Olivia Fay Cooper Wells brought suit against her husband, Lloyd William Wells, for divorce on the ground that he had wilfully inflicted upon her cruel treatment. She prayed that she be granted a divorce and that she be awarded temporary and permanent alimony. The defendant denied that he had cruelly treated the plaintiff, and, by way of cross action, asked for a divorce on two grounds, to wit: (1) mental cruelty, and (2) desertion. On the trial the jury returned the following verdict: “1. We find in favor of the defendant, grounds on cruelty; 2. divide entire estate equally.”…
