This is an action to cancel an oil and gas lease on plaintiff’s lands, comprising 320 acres. It is predicated on want of consideration, fraud, want of mutuality and plaintiff’s ignorance and mistake. Issue was joined by defendants’ answer, denying the material allegations of plaintiff’s complaint. A jury was expressly waived and the cause was tried to the court, which found in defendants’ favor.
