*346On the evening of November 24, 1906, about 11 o’clock p. m., appellant, John Anderson, with his father, crippled sister, and her two infant children, boarded one of appellee’s passenger trains at Middlesboro, Ky., to go to Grays. Appellant’s father gave him the money, and he purchased three tickets from the station agent.
