Walker v. Wainwright

This case came before the court on a motion by the plaintiff’s counsel, for the defendant to show cause why an injunction previously granted to restrain him from prosecuting a certain sentence of an ecclesiastical tribunal against the Rev. Mr. Walker, by pronouncing judgment of displacement from the ministry of the church, &c. should not be made absolute.

The view taken by me of one feature of this case will render unnecessary the examination of many of the questions which were discussed on the argument; and I shall, therefore, be silent in regard to them. The only ground on which this court can exercise any jurisdiction in this case is, that the threatened action of the defendant may affect the civil rights" of the plaintiff, for the protection of which he has a proper recourse to the civil courts.
