Affirming.

Appellants, Southern Railway Company and Louisville & Nashville Railroad Company, own and usa in common a railroad yard in Jellico, a town of about 3,500 inhabitants. In the month of September, 1906, an engine of the Southern Bailway placed in the north end of this yard a ear loaded with 400 boxes *221of dynamite and 50 boxes of nitroglycerin, which were placed on top of the dynamite. This car was placed in the yard abont 8 o’clock in the evening, and remained there until near 8 o’clock the next morning, when the dynamite and nitroglycerin exploded with…
