RICHARDS, Circuit Judge.
This suit was brought to recover the sum of $8,264.05, being a commission of 5 per cent, on $165,282.07, the purchase price paid' by the Cleveland Cliffs Iron Company to the Manistique Lumber Company for a tract of timber land in the Upper Peninsula of Michigan. At the conclusion of the testimony, upon motion, the court directed a verdict for the defendant. This action is assigned as error.
